Cancel Your Personal Training Contract in Canada

Alistair VigierBy Alistair VigierDecember 1, 2022No Comments5 Mins Read

If your gym won’t let you cancel your personal training in Canada, then just get a law firm to send them an angry letter. It probably costs you $50. There are tips from others below you should read.

I suggest formally requesting to cancel your personal training contract. Make sure to spell out all the specifics of your cancellation in the letter to avoid confusion. Indicate the deadline by which you plan to resign from the organization. Briefly explain your reason(s) for terminating your contract.

Recognize the gym’s cancellation policy and abide by it (are you within your right to cancel, will you pay the cancellation fee, are you eligible for a waiver, etc.). For written requests, write like this: “I’m writing to let you know that, as of [insert date], I’ll be [cancelling or not renewing] my personal training contract.

Secondly, think about freezing it instead of cancelling your gym membership while you are temporarily away from home, ill, injured, or too busy to exercise. Schedule a meeting with the gym management to talk about the potential of temporarily freezing your contract. Describe your position and your intention to freeze or renew your registration later. If you’ve moved into a building with a gym or started frequently travelling for work, think about freezing your contract.

If you’re like most professionals, you’re constantly looking for ways to improve your health. If you’re unhappy with your gym contract, there are several steps you can take to get out of it. Below, we outline the most common steps you can take to end your gym contract without any penalties.

    Consult with a lawyer

If you’re unhappy with your gym contract, it’s important to consult with a lawyer. A lawyer can help you negotiate a better contract, protect your rights, and ensure that you’re getting the most out of your membership.

Talk to your gym about your concerns

If you’re unhappy with your gym contract, the best way to resolve your concerns is to talk to your gym about them. Your gym may be willing to renegotiate your contract or even end it entirely. However, be prepared to fight for what you want if your gym doesn’t agree to your demands.

    Exercise your rights

If your gym won’t agree to your demands, you may have to exercise your rights. This means contacting your state’s consumer protection agency and filing a complaint. Your state may have laws that protect consumers from unfair contracts, and your complaint may result in a settlement or a court judgment in your favour.

    Leave quietly

If you don’t feel like your gym is listening to your concerns or is unwilling to renegotiate your contract, it may be best to leave quietly. Don’t publicly state your dissatisfaction with the gym or make any negative comments about the staff or the gym itself. This will only damage your relationship with the gym and may lead to sanctions or even termination of your contract.

    Termination of contracts

Several factors can influence your ability to exit a personal training contract with a gym. First, it is essential to understand the terms of your agreement. Some gyms may have strict policies regarding the cancellation or termination of contracts, so it is crucial to review this information in detail before making any decisions.

Generally, there are two main ways to get out of a personal training contract: by negotiating with the gym directly or consulting legal counsel. If you deal alone, try to be polite and respectful in all communications with the gym staff. Consider enlisting the help of a third-party mediator, such as an attorney or health professional with experience in similar situations.

Suppose you seek legal counsel, research and choose a lawyer who is well-versed in contract law. They will be able to guide the most effective ways to get out of your training contract without incurring any additional financial or legal costs. Also, be mindful of the timing and logistics of your exit. Depending on the nature of the agreement, you may need to give advance notice or pay a cancellation fee. The most important thing is to stay calm and focused throughout this process. Remember that other options are often available, and it is possible to find the right solution for your situation.

If you are getting into a dispute over how to cancel your personal training in Canada, get a lawyer to send a legal letter.

    FAQs

Do I have a cooling‑off period for personal training contracts?

Yes, in Ontario, you have a 10‑day cooling‑off period after receiving the contract or the services start, whichever comes later. You can cancel in writing for any reason, get a full refund, and face no penalty.

Can I cancel after the 10‑day window?

Possibly, if you never received a valid written contract, you can cancel within one year from signing. Or if unfair, oppressive terms were used (like misleading promises or misrepresentation), cancellation is allowed up to one year after signing.

What if the gym refuses to cancel or keeps charging me?

If your provider ignores your cancellation, you can file a complaint with your provincial consumer protection body (e.g., Consumer Protection BC or Ontario’s ministry). They can help enforce cancellation rights and refund policies.

Are personal training plans covered under consumer protection laws?

Yes. In BC and Ontario, personal training contracts are “continuing services contracts.” They must contain specific details and offer consumer cancellation rights. Failure to comply can render contracts void or refundable.

What evidence helps if I challenge a personal training contract cancellation?

Save your written cancellation notices (email or registered mail), a copy of the contract (or lack thereof), and any misleading verbal promises. Annotate any pressure tactics. These help if you need to dispute charges or file a complaint.
